Wrongful Death
When a person dies because of another person's negligent or wrongful behavior, it may be appropriate and proper to file a wrongful death claim. This type of claim lets family members receive compensation for the loss of their loved one, as well as for the loss of the comfort, love, companionship, and financial support they would have received from the person who died, had he or she not been killed. Death does not take away a family's rights to be compensated for their loss, and it also does not preclude recovery for the suffering and pain of the person who has died because of the wrongful or negligent act.
Who may file a wrongful death claim:
- A parent or parents of a child that has died
- The wife who has lost a husband
- The husband whose wife has died
- The parent or parents of a deceased child
- The child or children who have lost a parent
In a wrongful death claim, damages can include financial support from future earnings and benefits that would have been received if the deceased loved one were still alive, funeral and burial expenses, and any medical expenses.
